§ 22-465. Procedures:

  • (a)

    Registration.

    (1)

    All Pawnbrokers and dealers in precious metals will be required to register with the chief of police. The registration will consist of completing a sworn notarized application form, "Registration to deal in precious metals and gems."

    (2)

    Pay the initial registration fee of $25.00.

    (3)

    Renew registration each year by completing the registration form and paying a $10.00 renewal fee.

    (4)

    Comply with all State Law and with City of Madison codes, regulations and fees for a business license within the city limits of Madison.

    (5)

    The registration shall contain the name, address, and age of the dealer together with the names, addresses, and ages of all other persons having an ownership interest or actually employed in the business other than publicly held corporations.

    (6)

    No person shall be eligible to register as a dealer in precious metals or gems if any employee or stockholder, other than stockholders owning less than ten percent of the outstanding shares of a publicly held corporation, has been convicted of a felony under the laws of this state or any other state or the United States. This subsection shall not apply to any person who has been convicted of a felony after ten years have expired from the date of completion of the felony sentence.

    (7)

    All registrations shall contain the address of the premises upon which the business is conducted and the zoning and planning classification of the premises.

    (8)

    Each dealer shall be required to notify the police chief within seven calendar days of any change of address of the dealer or business or any change of ownership in the business. As to any notification of the chief of police, a copy of the change of address or ownership in the business shall be transmitted to the sheriff of the county within seven days of the notification.

    (b)

    Records retention. Every pawnbroker shall maintain a permanent record book in which shall be entered in legible English at the time of each loan, purchase, or sale:

    (1)

    The date of the transaction;

    (2)

    The name of the person conducting the transaction;

    (3)

    The name, age, and address of the customer; a description of approximate height and weight of the customer (or a photo of said customer); and the distinctive number from the customer's driver's license or other similar identification card;

    (4)

    A clear and accurate identification and description of the pledged or purchased goods, including, if reasonably available, the serial, model, or other number, and all identifying marks which have been inscribed thereon;

    (5)

    The number of the receipt or pawn ticket;

    (6)

    The price paid or the amount loaned;

    (7)

    If payment is made by check, the number of the check issued for the purchase price or loan;

    (8)

    The maturity date of the transaction (as per state law); and

    (9)

    The signature of the customer.

    A permanent record book will be provided by the chief of police to each pawnbroker and dealer in precious metals. This record book complies with Georgia law and contains the aforementioned information.

    (c)

    Transactions (purchased or pledged) in precious metals or gems.

    (1)

    Each transaction in precious metals or gems shall be entered in the same permanent record book provided by the chief of police. A separate log book is not required.

    (2)

    The receipt of precious metals and gems form shall be filled out for each transaction of precious metals or gems.

    (3)

    All information is required to be filled out, to include the normal, reasonable and customary step of obtaining a thumbprint of the customer on the top copy. The top copy shall be turned in to the code enforcement officer; the middle copy shall be kept by the business; the back copy shall be given to the customer.
