§ 22-466. Additional instructions, forms, log book.

  • (a)

    Any forms provided to the chief of police are the property of the city police department and will be issued as needed. It is prohibited for any person other than the chief of police or his designee to destroy or dispose of any such form, until four or more years from the creation of the record, unless otherwise required by governing law to be destroyed on a different schedule, in which case the governing schedule shall be adhered to. Any such forms shall be maintained in a locked container under the supervision of the appropriate law enforcement officer of the county or municipality and shall be available for inspection only for law enforcement purposes.

    (b)

    Each receipt of precious metals and gems form shall be "approved or prescribed by the appropriate law enforcement officer." The business will be responsible for any form issued to or used by the business.

    (c)

    The appropriate law enforcement officer of the municipality may, in his discretion, authorize any person who demonstrates theft of precious metals or gems by the presenting of an incident report or other similar document to inspect the reports in an effort to locate stolen property.

    (d)

    When the transaction log book has been completely filled, it shall be retained by the business for a period of four years from the date of the last entry, per State Law. "The record of each pawn or purchase transaction provided for in Code sections 44-12-132 and 44-12-133 shall be maintained for a period of not less than four years." A new log book will be issued by the code enforcement officer.

    (e)

    Entries shall appear in chronological order. No blank lines may be left between entries. No obliterations, alterations, or erasures may be made.

    (f)

    Said book shall be open to the inspection of any duly authorized law enforcement officer during the ordinary hours of business or at any reasonable time, to impede the sale of stolen property and to aid the police in recovering stolen items.

    (g)

    Requirements have been established for errors made in the transaction log book. Corrections shall be made by drawing a line of ink through the entry without destroying its legibility. If an error is made on a form, write VOID across the form and turn it in with all properly filled out receipts to the code enforcement officer.
